Terms of Service

These Terms govern your use of the Inkfill mobile application ("the App") and website, operated by Mowgli Labs, LLC ("Mowgli Labs," "we," "us," or "our"). By creating an account, subscribing to, or otherwise using Inkfill (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

1. What INKFILL does

Inkfill is a system of record for independent tattoo artists and studios. It provides a unified inbox for texts and email, lead and quote management, online booking and calendar tools, a private client waitlist with automated cancellation recovery, automated client communication, payments and payouts, client relationship tools, and AI-assisted drafting and insights throughout. Inkfill can be used as your primary scheduling tool, or alongside an existing scheduler you already use.

2. Your account

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• One account per artist or studio. You may not create accounts on behalf of others without their consent.
• You must be at least 18 years old and legally able to operate a tattoo business to use Inkfill.

3. Subscription and billing

• Inkfill is offered on a paid subscription plan, currently billed monthly or annually as described on our pricing page.
• New subscriptions may include a free trial period. No card is required to start a trial unless stated otherwise at signup.
• Subscriptions renew automatically at the end of each billing period unless cancelled beforehand.
• Payments are processed by a third-party payment processor. By subscribing, you also agree to that processor's terms.
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period, and we do not provide partial refunds for unused time except where required by law.

4. Deposits and client payments

• Inkfill lets you collect deposits from clients at the time of booking. Deposits are processed by our third-party payment processor.
• You are responsible for setting and communicating your own deposit, cancellation, and refund policies to your clients. Inkfill does not mediate refund disputes between you and your clients.
• Inkfill may charge platform or processing fees on deposits collected. These will be disclosed before you enable deposit collection.

5. Your client data and waitlist

The client contacts, appointments, notes, and preferences you import or enter into Inkfill remain yours. By using the Service, you represent that:

• You have the right to store this contact information and to message these individuals.
• Your clients have consented to receive SMS and/or push notifications about appointment availability, consistent with applicable messaging and privacy laws.
• You are solely responsible for the accuracy of your client data and the appropriateness of the messages you send through the Service.

You grant Inkfill a limited license to store, process, and transmit your client and waitlist data solely to provide the Service to you, including generating AI-powered insights and recommendations. We do not share your client data with other artists or studios. AI-generated insights (such as cancellation risk predictions or client recommendations) are provided to help inform your decisions — you remain responsible for your own scheduling and business decisions.

6. Acceptable use

You agree not to:

• Use the Service to send unsolicited or unlawful messages, including to individuals who have not consented to be contacted.
• Harass, threaten, or abuse other users or their clients.
• Attempt to access accounts or data belonging to others.
• Use the Service for any unlawful purpose.
• Reverse engineer, scrape, or attempt to extract data from the Service in an unauthorized manner.
• Upload, send, store, or otherwise transmit through the Service any content that is illegal, sexually explicit, or exploitative — including, without limitation, any image, message, or file depicting or involving child sexual abuse material (CSAM) in any form. This applies to every part of the Service that accepts an upload, including portfolio photos, flash designs, lead reference images, healing photos, message attachments, and profile photos.

Content you upload or send through the Service may be reviewed by automated moderation tools and, when reported by another user, by our team. Where legally required, we report known instances of child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) and cooperate with law enforcement.

7. Compatibility with other tools

If you choose to use Inkfill alongside another scheduling or booking tool instead of as your primary calendar, you are responsible for keeping both systems in sync. We are not responsible for the accuracy, availability, or performance of any third-party tool you use in connection with Inkfill.

8. Availability

We aim to keep Inkfill running reliably, but we do not guarantee uninterrupted availability or that every notification will be delivered instantly. We may perform maintenance, updates, or changes to the Service at any time.

9. Limitation of liability

To the fullest extent permitted by law, Inkfill is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including missed notifications, missed bookings, or disputes between you and your clients.

10. Termination

We may remove any content, and suspend or terminate your account, if you violate these terms — in particular Section 6 (Acceptable use). For a violation involving illegal or sexually explicit content, including any content described in Section 6, we may take this action immediately and without prior notice, and may report the content and your account to law enforcement or NCMEC as required by law. You may cancel your subscription and close your account at any time from within the app or by contacting us.

11. Changes to these terms

We may update these terms from time to time. We'll notify you of significant changes via the app or email. Continued use of Inkfill after changes are posted constitutes acceptance.

12. Governing law

These terms are governed by the laws of the United States. Any disputes will be resolved in the courts of competent jurisdiction.
